National Origin Discrimination
Employees of all nationalities are protected from national origin discrimination in the workplace by federal and state law. Immigrant employees have suffered national origin discrimination in employment historically. The difference today is that national origin discrimination is more subtle. It is highly unlikely that a manager or supervisor will directly reveal that an employment decision was made in part on the basis of the national origin of the employee. And it is much more likely that the manager or supervisor may not even be conscious of his or her attitudes regarding an employee's national origin.
National origin discrimination occurs in employment when employees of different nationalities are treated differently. National origin discrimination may motivate hiring decisions, disciplinary decisions, or termination decisions, and attitudes about nationality can influence perceptions of performance and conduct.
But however national origin discrimination may occur in the workplace, it is unlawful.
Any employee suspecting that his or her nationality has factored into an adverse employment decision should consider the possibility that the decision constitutes unlawful national origin discrimination and should contact an employment lawyer.
